Terms of Service

By downloading, installing or using Lohera (“the App”) you agree to these Terms. If you do not agree, do not use the App. These Terms form a legally binding agreement between you and OÜ Datadaa, the operator of Lohera.

Lohera provides kitesurfing-spot recommendations based on ocean and weather forecast data from third-party providers, scored against your IKO skill level, weight, and kite sizes. The App is provided for informational purposes only.

Kitesurfing is an inherently dangerous activity. Lohera is a helper tool, not an ultimate source of truth and not a substitute for your own judgment. You are solely responsible for deciding if, when, and where to ride, for assessing your own skill level, and for checking real-world conditions before entering the water. Always follow basic safety practices, including respecting local rules and hazards, avoiding unsafe conditions, and not riding alone.

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at hello@lohera.com if you suspect unauthorised use.

You agree not to:

• Use Lohera in any way that could damage, disable, overburden, or impair the service
• Attempt to gain unauthorised access to any part of the service or its servers
• Scrape, copy, or redistribute spot data, forecast data, or scored output for commercial use without permission
• Use Lohera to harass, abuse, or harm other users
• Misrepresent your skill level or other profile information in ways that could endanger others (e.g. when sharing planned sessions)

Lohera’s kite-spot database is built from community sources plus public geographic data, with original short descriptions written by Lohera. The scoring, wind-window derivation, and kite-size logic are Lohera’s own work. Spots are listed for informational purposes; we do not warrant access rights or local launch permissions. Always check local regulations and respect spot etiquette before riding.

Forecast data reflects model output, not direct measurement. Conditions on the water often differ from forecast — wind can shift, gust, or die. You agree that Lohera makes no guarantee of forecast accuracy, score accuracy, kite-size suitability, or safety at any spot or time. You must independently verify actual conditions and make your own decisions at your own risk.

All rights in and to the App, including the brand, software, designs, and original content, are owned by OÜ Datadaa. You receive a personal, non-exclusive, non-transferable licence to use the App on devices you own or control.

You use Lohera entirely at your own risk. To the maximum extent permitted by law, OÜ Datadaa accepts no responsibility or liability for any loss, damage, injury, or claim arising out of or related to your use of the App, reliance on any recommendation, forecast, score, or kite-size suggestion, or your decision to enter or not enter the water. This includes direct, indirect, incidental, special, consequential, or punitive damages, and loss of profits or revenues. Where a total exclusion is not legally permitted, total liability is limited to €100 or the amount you paid for the App in the preceding 12 months, whichever is greater. Nothing in these Terms limits liability that cannot be excluded by law (including for fraud or willful misconduct).

You may stop using Lohera at any time and delete your account from the Profile screen. We may suspend or terminate your access if you breach these Terms or use the App in a way that could harm us or other users.

These Terms are governed by the laws of Estonia. Any dispute will be resolved in the courts of Estonia, unless mandatory consumer-protection laws in your jurisdiction provide otherwise.

We may update these Terms from time to time. If we make material changes, we will notify you via the app or email at least 14 days before they take effect. Continued use of Lohera after that date constitutes acceptance.
